I have a thing for the 1st amendment

I'm incredibly interested to see what happens here:



According to the law (communication...much love to Jere Hoar)...as I interpret it....having studied it since NYTIMES v. Sullivan on down......

Reagan committed a felony.

He asked an audience of 9 million + to murder a human being.

He essentially put out a hit on Mark Dice.

It will be interesting to see if Reagan faces any repercussions. I'm sure he won't....but note that this is a direct act of violence which is not protected by the 1st amendment.

Contrary to popular belief, the 1st amendment is not an "a priori right" to Americans.....it has it's contingencies.

The hypothesis which is most commonly used to define this contingency is: "You can't yell fire in a crowded theater."

If you use free speech to invoke "imminent lawless action", i.e., rioting, panic, a threat to national security..... and of course murder....your 1st amendment rights are sacrificed and you can be charged with any number of felonies.

Damn i love America.

By the way....If you haven't watched the entire John Adams series on HBO....please do so. It's incredible.

Glenn Beck, of whom the great Ashley Morris once asked "Does CNN think it has to give the Nazi party equal time?", made a similar on-air threat to Michael Moore.

He did not suffer any consequences. This is America 2008.
